The Huffington Post quotes Professor Caitlin Borgmann in an article discussing a “wrongful conception” case filed against Qualitest Pharmaceuticals. The company mislabeled birth control pills, resulting in Shanta Russell’s pregnancy. Russell is suing Qualitest and seeking damages not only for emotional pain and health care, but also for the cost of putting her child through private school and college. Courts, however, rarely award compensation for child-rearing. “The majority of courts see the birth of a child as an unmitigated blessing,” said Borgmann.
Professor Borgmann has litigated reproductive rights cases and has also spoken and written widely about reproductive rights and given testimony before several state legislatures on this issue. She is also the editor of the Reproductive Rights Blog.
